More effective sanctioning

More effective sanctioning

This thematic analysis from NTAES examines how administrative and criminal sanctions against labour-market crime can work together more effectively. The report describes the range of reactions available to the various agencies and discusses how coordinated use can produce a stronger combined effect.

The analysis is aimed at cooperating agencies, the Ministry of Justice and other ministries, as well as decision-makers who shape the regulatory and sanctioning framework. It provides a basis for assessing whether existing instruments are adequate, or whether adjustments are needed to ensure a proportionate and credible response to serious violations.

Discussion

The report discusses criteria for choice of sanction, division of work between administrative and criminal tracks, and the importance of predictability and equal treatment. NTAES points out that effective sanctioning depends not only on the tools themselves, but also on how they are used in practice and how information is shared between agencies.
